Terms of Service for GuideSavvy
TOS agreement
This Agreement contains the complete terms and conditions that apply to an individual's or entity's participation in the GuideSavvy.com Member Program (the "Program"). GuideSavvy Approved Guides are referred to as “members.” As used in this Agreement, "we" means GuideSavvy, and "you" means the applicant. "Site" means www.GuideSavvy.com.

Enrollment in the program
- To begin the enrollment process you will need to submit all of the information requested of you. Once you have provided all of the information necessary to “apply” to become a recognized Approved GuideSavvy Guide, we will evaluate your information to determine if you are accepted or rejected as a GuideSavvy Approved Guide. If you have been rejected then you will be able to remain on the site however, your listing will be seen below other qualifying members and you will not be given the status of “Approved GuideSavvy Guide”
- Here is what you receive by enrolling in the “program”
- Biography page - Info about you the guide
- Photo page -Post up to 25 pictures
- Video Page -Can post up to 2 videos up to 5 minutes long each
- Article page - Can upload articles that you have written and that are not copy write protected.
- Fishing report page - Post current fishing reports that subscribers will receive by email and can search for on the site
- Calendar page - You can display all of the dates that are available or booked for subscribers to plainly see. This feature allows the subscriber to “book a trip” with you online.
Soon you will have your fishing reports emailed to our subscribers every week which is a great marketing tool for you to drive traffic to your pages here and also to your site.

Qualifications needed to be an Approved GuideSavvy Guide
In order to be an “Approved GuideSavvy Guide” you must meet these qualifications at all times:
- You must have been guiding for at least 5 consecutive years full time. (major source of income)
- Fully insured and licensed.
- Good standing with sponsors and or Marina’s.
- Must provide us with the names of 3 recent clients who are willing to answer questions about the service they received. This is a future requirement not yet in force
- The member must maintain an average score of 3 out of 5 maximum for customer reviews. The questions will also be completed after any new client hires the guide through the site after the trip has taken place, ideally within 1 day of the trip.
Questions clients will be asked are as follows:
How would you rate the guides knowledge of the water you were fishing in?
How would you rate the guide's overall fishing knowledge?
How would you rate your guides willingness & determination to help you catch fish?
How would you rate your guides professionalism and overall attitude?
Would you rehire this guide or refer them to someone else?
The scale is from 1-5.
The scores will be totaled based on this. If your score averages 3 or higher then you will be recognized as an Approved GuideSavvy Guide or AGG. This means that you will be listed above any guides who do not qualify in the search results. Your score will determine how you will be listed on the page. Higher scores are listed above those with lower scores. Your score will be seen next to your name in the list along with an icon that shows that you are an Approved GuideSavvy Guide. Then the non qualified guides will be listed alphabetically after this.

Requirements & expectations to remain in the “program”
- All members are requested to maintain their fishing reports and keep them current. If fishing reports are not being maintained by the member then that member can lose his status as an Approved GuideSavvy Guide. If this happens then at the discretion of GuideSavvy said member can be removed from the site. All members who wish to keep their status in good standing agrees to this policy in full and will comply without having to be asked repeatedly.
- Each member will be given a login where said member can visit the site and update the fishing reports, photo’s, video’s, articles, and biography information at the discretion of the member. Please manage this as a professional in a timely manner. No photo’s or video’s or wording shall be accepted if they are construed as sexual, in poor taste, bad judgment, foul, or racially, religiously or gender biased in any way shape or form. If this is misused by the member they will lose their status and can be removed from the site instantly without warning at the discretion of GuideSavvy.
- Members are expected to carry themselves with decency and with dignity and professionalism at all times. Clients expect to be followed up upon in a timely manner once they initiate the hiring process. GuideSavvy expects its members to be exemplary in their dealings with these clients.
- Members must maintain the calendar on the site as best as possible. GuideSavvy cannot be held accountable for any date that is not filled out properly or that shows availability or if it is booked improperly. GuideSavvy will send emails to all its members when said member receives a booking request from a client. This is only a request and you have final say as to if you want to approve the date. If you approve the date or you do not approve the date, you must contact the client at their email address and telephone number to let them know you accept or decline their offer.

Identifying yourself as a GuideSavvy Approved Guide
You are welcome to publish or broadcast your affiliation and your standing with GuideSavvy only if you are in good standing and qualify as an Approved GuideSavvy Guide.

Term of the Agreement
The term of this Agreement will begin upon our acceptance of you as an Approved GuideSavvy Guide and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination 30 days prior to the date cancellation is desired. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all links to our site, and all GuideSavvy.com trademarks, trade dress, and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the Program.

Modification
We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on our site. Modifications may include, for example, changes in the scope of requirement guidelines, questions asked to clients, payment procedures, and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOU’RE CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

Relationship of Parties
Nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Section.

Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.

Disclaimers
We make no express or implied warranties or representations with respect to users registered through the Program. In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Arbitration
Any dispute relating in any way to this Agreement (including any actual or alleged breach hereof), any transactions or activities under this Agreement or your relationship with us or any of our members shall be submitted to confidential arbitration in FL., except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the state of Florida (and you consent to non-exclusive jurisdiction and venue in such courts) or any other court of competent jurisdiction. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Miscellaneous
This Agreement will be governed by the laws of the United States and the state of Florida, without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
